Official Rules
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
OPEN TO EARLY BIRD BOOKS MEMBERS WHO ARE LEGAL RESIDENTS OF THE 50 UNITED STATES AND DISTRICT OF COLUMBIA WHO, AS OF THE TIME OF ENTRY, ARE AT LEAST 18 YEARS OLD.
VOID IN PUERTO RICO AND ALL JURISDICTIONS OTHER THAN THOSE STATED ABOVE AND WHERE PROHIBITED OR RESTRICTED BY LAW.
SPONSOR. The “Early Bird Books Official Sweepstakes” (“Sweepstakes”) is sponsored by Early Bird Books, Open Road Integrated Media, Inc. (“Sponsor”), 180 Maiden Lane, Suite 8A, New York, NY 10038
HOW TO ENTER.
NO PURCHASE NECESSARY AND NO ENTRY FEE, PAYMENT OR PROOF OF PURCHASE IS NECESSARY TO PARTICIPATE.
To enter, respond correctly to any Early Bird Books-sponsored sweepstakes offer by filling out the form provided by the sweepstakes sponsor (“Sponsor”), or by following the instructions specified in the particular sweepstakes.
Limit one (1) entry per person/email address. No automated entry devices and/or programs permitted. All entries become the sole and exclusive property of the Sponsor and receipt of entries will not be acknowledged or returned.
Sponsor is not responsible for lost, late, illegible, stolen, incomplete, invalid, unintelligible, misdirected, technically corrupted or garbled entries, which will be disqualified, or for problems of any kind whether mechanical, human or electronic. Only fully completed entry forms are eligible. Proof of submission will not be deemed to be proof of receipt by Sponsor.
Compliance with the entry requirements will be determined by Sponsor in its sole discretion. Submissions that violate, as determined by the Sponsor, in its sole discretion, the foregoing entry requirements will be disqualified from the Sweepstakes.
ELIGIBILITY.
The Early Bird Books $500 Invite Your Friend Sweepstakes (the “Sweepstakes”) is open only to Early Bird Books members who are legal residents of the fifty (50) United States and D.C. eighteen (18) years of age or older at the time of entry. Void in Puerto Rico and where prohibited or restricted by law. Officers, directors, employees and agents of Sponsor and any other entity involved in the development or administration of this Sweepstakes (Sponsor, collectively with the foregoing, the “Sweepstakes Parties”) and members of their immediate families (i.e. spouses, parents, children, siblings, and “steps” of each) and all those persons living in the same household of each, whether or not related, are not eligible to enter or win the Sweepstakes. All applicable federal, state, and local laws and regulations apply.
By participating in the Sweepstakes, entrants agree to be bound by these official rules (“Official Rules”) and by the decisions of Sponsor in all matters relating to the Sweepstakes.
ENTRY PERIOD.
The entry period for the Sweepstakes begins on July 3, 2018 at 12:00:00am ET and ends on August 3, 2018 at 11:59:59 PM ET (“Entry Period”). Sponsor’s computer is the official time keeping device for the Sweepstakes.
ODDS OF WINNING.
The odds of winning the Sweepstakes depend on the number of eligible entries received.
WINNER SELECTION AND NOTIFICATION.
On or about August 3, 2018, one (1) winner will be randomly selected from among all eligible entries received. Sponsor will notify the winner on or about August 3, 2018 via e-mail.
The winner’s right to receive the prize is subject to verification of eligibility, including verification of age and residency by submission of a driver’s license or other evidence satisfactory to Sponsor. The winner must also provide Sponsor with a valid postal mailing address to facilitate delivery of the prize.
If a winner (i) is determined to be ineligible or otherwise disqualified by Sponsor, (ii) fails to respond to Sponsor’s first winner notification message within five (5) days of notification or after two (2) attempts (whichever occurs first), or (iii) fails to provide winner’s postal address to Sponsor for prize delivery purposes, the winner will be disqualified, will forfeit all interest in the prize, and a substitute winner will be selected by Sponsor based on a random drawing from among all remaining eligible entries.
PRIZE.
A random drawing will be conducted in connection with the Sweepstakes to award one (1) $500 AMEX Gift Card to one (1) winner. The actual retail value of the prize is $500. The total retail value of all prizes to be awarded in the Sweepstakes is $500.
The prize will be mailed to the postal address provided by winner to Early Bird Books within thirty (30) days of Early Bird Books’s final determination of the winner. Sponsor’s obligation to fulfill the prize will be fully discharged by depositing the prize into the mail addressed to the address provided by winner. The winner will bear all risk of lost, stolen or misdelivered mail.
The right to receive the prize cannot be transferred or assigned. No prize substitution is permitted, except at the sole discretion of the Sponsor. If the prize cannot be awarded for any reason, Sponsor reserves the right in its sole discretion to substitute a prize (or any prize component) with one of comparable or greater retail value.
The winner is solely responsible for all federal, state, local, or other applicable taxes associated with the acceptance and use of the prize. All costs and expenses associated with prize acceptance and use not specifically provided herein are the responsibility of the winner.
Except where prohibited by law, by accepting the prize, winner grants the Sponsor and its affiliates, successors and assigns, and others that Sponsor may designate from time to time, the unconditional right, license and permission to use winner’s name and likeness worldwide, in all forms of media, in perpetuity, on a royalty-free basis, without further compensation or approval, to administer and promote the Sweepstakes and for any other promotional, advertising, publicity or other lawful purposes.
Limitations of Liability of Sweepstakes parties.
Lost or Corrupted Entries: The Sweepstakes Parties assume no liability and are not responsible for, and entrants hereby forever waive any rights to any claim in connection with, lost, late, incomplete, corrupted, stolen, or misdirected entries or mail, or for any computer, telephone, cable, network, satellite, electronic or Internet hardware or software malfunctions, unauthorized human intervention, or the incorrect or inaccurate capture of entry or other information, or the failure to capture any such information.
Damaged Property: The Sweepstakes Parties assume no liability and are not responsible for, and you/entrant hereby forever waive any rights to any claim in connection with, injury or damage to any entrant’s or to any other person’s computer, mobile device, or property related to or resulting from participating in this Sweepstakes. Sweepstakes Errors: The Sweepstakes Parties assume no liability and are not responsible for, and you/entrant hereby forever waive any rights to any claim in connection with, errors and/or ambiguity: (a) in the Sweepstakes; (b) in any Sweepstakes related announcements, advertising or promotions; and/or (c) in these Official Rules. In the event of any ambiguity or error(s) in these Official Rules, Sponsor reserves the right to modify these Official Rules for clarification purposes or to correct any such ambiguity or error(s). If due to an error or for any other reason, more legitimate prize claims are received than the number of prizes stated in these Official Rules, Sponsor reserves the right to award only the stated number of prizes (i.e., one prize) in a random drawing from among all verified and legitimate prize claims received. In no event will more than the stated number of prizes be awarded. Release and Indemnity: Each entrant in this Sweepstakes, including, without limitation, the winner, hereby releases, indemnifies and agrees to hold harmless the Sweepstakes Parties from any and all liability for any injuries, loss or damage of any kind to person, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of the Sweepstakes prize, participation in this Sweepstakes and participation in any activity related to this Sweepstakes. TO THE FULLEST EXTENT PERMITTED BY LAW, THE SWEEPSTAKES PARTIES WILL NOT BE RESPONSIBLE OR LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR/ENTRANT’S ACCESS TO AND USE OF THE SWEEPSTAKES OR THE DOWNLOADING OF MATERIAL RELATED TO AND/OR PRINTING MATERIAL DOWNLOADED FROM THE SWEEPSTAKES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT A PARTICIPANT, TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND PURSUE ALL OTHER REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
Sponsor’s Reservation of Rights.
If the Sweepstakes is not capable of running as planned for any reason, including without limitation, due to a force majeure event or infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, Sponsor reserves the right, at its sole discretion, to cancel, modify, or terminate the Sweepstakes. In the event of cancellation, Sponsor reserves the right to select a winner from a random drawing of all eligible, non-suspect entries received prior to cancellation. In the event that an entry is confirmed to have been erroneously deleted, lost or destroyed, entrant’s sole remedy shall be another entry into the Sweepstakes if it is practicable to award such additional entry at the time the error is confirmed by Sponsor.
Governing Law.
THE SWEEPSTAKES IS GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF MASSACHUSETTS, WITHOUT REGARD TO ITS CONFLICTS OF LAW PRINCIPLES.
Privacy.
Any personally identifiable information collected during an entrant’s participation in the Sweepstakes will be used by Sponsor in accordance with Sponsor’s privacy policy available at https://earlybirdbooks.com/privacy-policy.
Winner’s List.
For the name of the winner, send an email to editors@earlybirdbooks.com. Requests must be received no later than sixty (60) days after the end of the Entry Period.
NO WAIVER/SEVERABILITY/RIGHT TO MODIFY OR DISCONTINUE SWEEPSTAKES.
Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. If any provision of these Official Rules is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced. Sponsor reserves the right to modify or discontinue the Sweepstakes at any time.
